GENERAL PRIZE PROMOTION TERMS & CONDITIONS

BIRRA MORETTI: Birra Moretti Online Gaming Prizes 2024

These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry instructions are deemed to form part of the terms and conditions and by entering this promotion all participants will be deemed to have accepted and be bound by the terms and conditions. Please retain a copy for your information.

The personal data provided by entrants will only be used by the Promoter for the purpose of conducting the promotion and at all times in accordance with the Data Protection Act 2018 and the Promoter’s Privacy Policy (available at https://www.heineken.co.uk/legal-hub/heineken-brands-privacy-policy). From time to time, the Promoter may share entrants’ personal data with their agents/representatives to assist with administering the promotion and contacting entrants (as necessary) and/or fulfilling the prize(s).

1. Only open to residents in the UK and Channel Islands and Isle of Man aged 18 or over, excluding employees of any company in the Heineken group and any person whom, in the Promoter’s reasonable opinion, should be excluded due to their involvement or connection with this promotion.

To take part in the promotion, play the “Shop the Ape” game. To access, scan the QR code on the Birra Moretti Sale Di Mare Glassware box (subject to availability) OR play the game on the Birra Moretti website https://www.birramoretti.com/gb/en/ape-game. Enter between 09:00 on 26/2/24 and 17:00 on 31/10/24. Your standard network rates apply.

2. Before playing the game, input your first name, last name and email address to enter the prize draw. Once you’ve submitted these details, you will then be prompted to play the game. To play the game, pick a coastal recipe and then find the recipe ingredients hidden in the Ape by tapping on the appropriate ingredients. There are 3 recipes to choose from. Recipe ingredients as shown on the screen must be selected within 30 seconds. You can play the game multiple times but entry into prize draw is limited to one per person per month. Entry to the draws is not based on game score. You will be required to enter your details once per month for entry into the relevant draws. If a player wins a prize, their home address will be required for delivery.

3. Prizes are as follows:

a. BIRRA MORETTI Sale Di Mare branded pizza board (400 total available)
b. BIRRA MORETTI Sale Di Mare branded serving board (400 total available)

4. Entries must be made personally. Entries made through agents/third parties, bulk entries or automated entries are invalid. No entries submitted via any other means will be accepted. The promoter cannot guarantee uninterrupted or secure access to the web entry route. Any mechanical reproduction or automated entries in excess of one per person per month is prohibited, and any use of such automated devices will cause disqualification.

No-one can win more than one prize. Winners will receive either 1x pizza board or 1x serving board only. Prizes will be assigned at random, winners will not be able to choose which prize they receive and they are not exchangeable.

5. Winners will be the first 100 entries selected at random from all valid entries on the dates set out below on the relevant draw dates set out below. The prize draws will be conducted monthly by an independent adjudicator and prizes will be allocated at random. The judge’s decision is final.

Winner selection will take place from 8th April 2024 to 7th Nov 2024.

There are 8 monthly nationwide draws for the chance to win one of x100 monthly prizes (total number of prizes available across the full promotional period is x800).

The Promoter reserves the right to verify all entries and winners, and to refuse to award a prize or withdraw a prize entitlement and/or refuse further participation and disqualify the participant where there are reasonable grounds to believe there has been a breach of these terms and conditions or any instructions forming part of entry requirements or otherwise where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means. The Promoter will be the final arbiter in any decisions, and these will be binding, and no correspondence will be entered into.

7. The winners will be notified by email no later than 1 week after the draw. The winners will be notified via email to the email address with which the entry was made. If the winners cannot be contacted or do not reply within 7 days to accept the prize, the Promoter reserves the right to re-draw and select new winners at random from all valid entries as set out in Term 5 (and so on until winners can be contacted who will take up the prizes).

8. The winners will have a further 7 days, starting on the day they accept the prize to provide full name and any required postal address details to fulfil their prize. Prizes will be dispatched within 28 days.

9. Prizes will be dispatched by registered post and a signature may be required. Prizes returned undelivered are assumed unwanted and an alternative winner will be selected via a mop up draw on 5th December 2024. Winners of any such prizes will be contacted as set out in Term 7 above. The process will repeat until an eligible winner is able to claim each prize.

10. Winners’ details (first names and county only) will be available for 3 months from 5th December 2024 by sending a Stamped Addressed Envelope to BIRRA MORETTI SALE DI MARE APE GAME WINNER, Mesh Marketing, 16 Laystall St, London, EC1R 4PF. By entering, the winner consents to such information being disclosed upon request.

11. There is no cash or other alternative to these prizes in whole or in part but the promoter reserves the right to substitute the prize of an equivalent value should the prize become unavailable for any reason.

12. Prizes are not transferable, exchangeable or refundable. The Promoter reserves the right to reclaim the prize if it is transferred.


13. The decision of the promoter in all matters is final and binding and no correspondence will be entered into. The promoter is not responsible for any third-party acts or omissions.

14. The promoter reserves the right to cancel or amend this promotion due to events or circumstances arising beyond its control.

15. All conditions, warranties and representations expressed or implied by law or otherwise in connection with the prize are excluded to the fullest extent permitted by law and the promoter shall be under no liability whatsoever or however in connection with any loss, damage or injury suffered as a direct result of the provision of the prize.

16. All taxes (including without limitation national & local taxes) in connection with any prize & the reporting consequence thereof, are the sole responsibility of the prize winner.

17. These rules and any dispute or difference arising out of or in connection with them shall be governed by and construed in accordance with English law. The Promoter and each entrant irrevocably agrees to submit to the exclusive jurisdiction of the Courts of England and Wales over any claim or matter arising under or in connection with these rules or the legal relationships established by this agreement.
